Terms and Conditions
Last updated: November 5, 2026
Welcome to Oyetu Cloud, operated by Oyetu Network CC ("we", "our", or "us"), based in Namibia. By accessing our website at cloud.oyetu.org, registering an account, or purchasing our shared hosting, VPS services, domain registrations, or managed software deployments (such as BigCapital Accounting), you agree to be bound by these Terms and Conditions.
1. Account Registration and Use
You must provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the security of your account credentials and password. Oyetu Network CC cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
2. Service Terms and Beta Offers
We provide managed cloud infrastructure, shared web hosting, and software deployment services. During promotional beta phases:
- Discounts apply strictly to the duration or billing cycles specified in the active promotion.
- Services may involve preview features or active adjustments while we optimize performance.
- We reserve the right to modify, suspend, or discontinue any promotional tier with prior notice to active subscribers.
3. Billing, Payments, and Renewals
Fees for services are billed on a prepaid basis (monthly or multi-month block options). Payments may be completed via supported local mobile wallets (such as FNB eWallet), direct bank transfers, or automated online processing gateways like PayPal.
- Invoices are generated ahead of the renewal date. Non-payment may result in suspension or termination of service instances.
- Domain registrations are non-refundable once processed through registries.
- For information regarding service terminations and money-back requests, please review our separate Refund Policy.
- Services that are not paid by the due date enter a 5-day grace period during which they stay online. If payment is not received by the end of the grace period, the service is marked expired and suspended. A suspended service can be reactivated once the open invoice is paid.
- Invoices for all orders and renewals are available, to view, print or download, under Invoices in your client dashboard.
4. Acceptable Use Policy (AUP)
You agree not to use Oyetu Cloud infrastructure to host, transmit, or distribute content that:
- Violates any applicable Namibian laws or international regulations.
- Infringes upon intellectual property rights, copyrights, or privacy rights of third parties.
- Involves malware, phishing scripts, malicious botnets, unauthorized scanning, or unsolicited bulk email (spam).
- Imposes unreasonable, disproportionate, or excessive loads on our underlying hardware infrastructure.
We reserve the right to suspend or terminate any service immediately, without notice, if an account violates this Acceptable Use Policy.
5. Backups and Data Loss
While we implement automated offsite backups depending on your selected hosting tier, you maintain sole responsibility for maintaining independent local copies of your website files, databases, and accounting records. Oyetu Network CC is not liable for data loss resulting from user error, security breaches originating from unpatched third-party application code, or catastrophic infrastructure failure beyond reasonable control.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Oyetu Network CC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with your use of our hosting and cloud platforms.
7. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of Namibia.
8. Affiliate (Referral) Program
Registered customers can earn commission by referring new clients to Oyetu Cloud.
- Each account has a personal referral link in the Affiliate page of the client dashboard.
- A new client who signs up through your link receives 10% off the first month of their first order, applied to their first invoice.
- You earn 10% commission on each payment we receive from a client you referred, for 12 months starting from that client's first paid invoice.
- Commission is earned only on payments actually received. If a payment is refunded, reversed or charged back, the related commission is cancelled and may be deducted from future payouts.
- Commission earned in a calendar month is paid once a month by EFT to the bank account you provide in your dashboard. We cannot pay you until valid bank details are on file.
- Referring yourself, or accounts you own or control, is not allowed. Spam, misleading claims and any abuse of the program may lead to commissions being withheld or cancelled and your participation ending.
- You are responsible for any tax that applies to the commission you receive.
- We may change or end the program at any time. Changes do not affect commission already earned.
